Food Safety & Allergen Disclosure

This Food Safety & Allergen Disclosure (the “Disclosure”) forms an integral part of our Terms of Service and applies to all food, beverage, nutritional, sports nutrition, and dietary supplement products (collectively, “Food Products”) sold or provided as Gift with Purchase (GWP) items across all relevant product categories on our website. Capitalized terms used herein have the same meaning as in our Terms of Service, Gift with Purchase Promotion Rules, Shipping Policy, International Shipping Info, and Return & Refund Policy.

By purchasing, ordering, accepting, or consuming any Food Product from us, you acknowledge that you have read, understood, and agree to be bound by all terms of this Disclosure.

1. Definitions

· Food Products: All edible products, beverages, nutritional supplements, sports nutrition products, and dietary items sold or offered as GWP items through our website, including but not limited to alcoholic beverages, craft beers, wine, protein powder, creatine, protein bars, electrolyte mixes, whole bean coffee, plant-based beverages, and olive oil.

· Manufacturer: The licensed food manufacturer that produces, formulates, packages, labels, and qualitycontrols the Food Product. The manufacturer is the entity with primary and exclusive responsibility for product safety, formulation, labeling, and regulatory compliance.

· Priority Food Allergens: The eight major food allergens recognized by the U.S. Food and Drug Administration (FDA), the European Food Safety Authority (EFSA), and Codex Alimentarius: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, and soybeans.

· CrossContamination: The unintentional transfer of allergens, ingredients, or contaminants from one food product to another during production, processing, packaging, storage, handling, or transportation.

· GWP Food Item: A Food Product provided as a complimentary promotional gift under our Gift with Purchase program, subject to all terms of this Disclosure and our GWP Promotion Rules.

· MSRP: Manufacturer’s Suggested Retail Price, the official retail price published by the manufacturer of a Food Product or GWP Food Item. MSRP is the sole and exclusive valuation reference for all GWP Food Items for all purposes.

2. Core Responsibility Allocation

2.1 Manufacturer’s Primary and Exclusive Responsibility

All Food Products sold or provided as GWP items on our website are manufactured, packaged, labeled, qualitycontrolled, and safetytested exclusively by their respective licensed manufacturers.

Product safety, formulation, ingredient accuracy, allergen control, nutritional information, labeling compliance, and all food safety and product liability matters are the sole and primary responsibility of the manufacturer.

As an authorized reseller and distributor, we only:

· source Food Products directly from authorized manufacturer channels and authorized distributors;

· reproduce product information, ingredient lists, nutritional facts, and allergen statements as provided by the manufacturer;

· assist customers with manufacturer contact and warranty claims where commercially reasonable.

We do not manufacture, formulate, test, alter, or repackage any Food Products. We do not independently verify the accuracy, completeness, or reliability of manufacturerprovided ingredient, allergen, nutritional, or safety information. We do not assume any liability for manufacturing defects, labeling errors, crosscontamination, or food safety issues beyond what is required by applicable law.

2.2 No Medical or Dietary Advice

All information provided about Food Products is for informational purposes only and is not intended as medical advice, dietary advice, or a substitute for consultation with a qualified healthcare professional.

Food Products are not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition. Individuals with specific dietary needs, food allergies, medical conditions, or special dietary requirements should consult a qualified healthcare professional before consuming any Food Product.

3. Allergen Disclosure

3.1 Priority Food Allergens

Food Products may contain or come into contact with one or more of the eight priority food allergens:

1. milk and dairyderived ingredients;

2. eggs and eggderived ingredients;

3. fish and fishderived ingredients;

4. crustacean shellfish and shellfishderived ingredients;

5. tree nuts and tree nutderived ingredients;

6. peanuts and peanutderived ingredients;

7. wheat and wheatderived ingredients;

8. soybeans and soyderived ingredients.

Specific allergen information for each individual product is displayed on the product page and printed on the product packaging, as supplied directly by the manufacturer.

3.2 CrossContamination Risk

Many Food Products are manufactured, processed, packaged, or stored in facilities that also process products containing allergens. There is an inherent risk of crosscontamination with trace amounts of allergens, including but not limited to the priority allergens listed above, even if the Food Product itself does not contain the allergen as an intentional ingredient.

Manufacturers may use shared production lines, shared equipment, shared storage facilities, or shared packaging environments. We cannot and do not guarantee the absence of trace amounts of allergens in any Food Product.

Individuals with severe food allergies, anaphylaxis, or multiple food allergies should exercise extreme caution and review the manufacturer’s official product packaging and labeling carefully before consumption.

3.3 Additional Allergens & Sensitivities

In addition to the eight priority allergens, Food Products may contain or come into contact with other allergens, ingredients, or substances that may cause reactions in sensitive individuals, including but not limited to:

· sesame, mustard, celery, lupin, molluscs, and added sulfites (as applicable by jurisdiction);

· artificial colors, artificial flavors, and preservatives;

· naturally occurring or added histamines;

· caffeine, alcohol, and other stimulants or depressants.

4. Food Safety & Product Information

4.1 Manufacturing Standards

All Food Products are manufactured in facilities that comply with the food safety regulations of the country of manufacture. U.S.manufactured products are produced in compliance with FDA regulations and applicable Good Manufacturing Practices (GMP). EUmanufactured products comply with EFSA standards and applicable EU food safety regulations.

However, we do not independently audit, inspect, or verify manufacturer compliance with food safety standards. All safety and quality representations are those of the manufacturer.

4.2 Product Information Disclaimer

Ingredient lists, nutritional information, serving sizes, allergen statements, country of origin, and product descriptions are provided by the manufacturer. While we make every effort to display this information accurately on our website, we do not warrant that it is complete, accurate, uptodate, or errorfree.

Product formulations, ingredients, recipes, and packaging may change at any time at the manufacturer’s sole discretion. The product packaging and labeling received may differ from information displayed on our website. You should always read the actual product label, warnings, and instructions provided by the manufacturer before consuming any Food Product.

4.3 Storage & Shelf Life

All Food Products have a limited shelf life and require proper storage. Storage recommendations and expiration or bestby dates are established by the manufacturer and are printed on the product packaging.

You are solely responsible for proper storage of Food Products after delivery. We are not liable for spoilage, deterioration, or quality issues resulting from improper storage, temperature abuse, or handling after delivery.

5. Regional Regulatory Compliance

The following regional provisions apply to Food Products sold or shipped to the respective jurisdictions, in addition to the general terms above.

5.1 United States

All Food Products sold in the United States comply with applicable FDA regulations and federal and state food safety laws.

California Proposition 65 Warning
WARNING: Consuming Food Products sold on this website can expose you to chemicals including lead, acrylamide, and/or other substances, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov/food.

This warning is provided in accordance with California Proposition 65. The presence of a warning does not mean the product is unsafe, only that it contains detectable amounts of a listed chemical.

5.2 European Union

Food Products sold into the European Union comply with applicable EFSA regulations and EU food information and labeling requirements, including Regulation (EU) No 1169/2011 on the provision of food information to consumers.

Allergen labeling follows EU 1169/2011 requirements. Products may contain or may come into contact with allergens as indicated on the manufacturer’s packaging.

5.3 United Kingdom

Food Products sold into the United Kingdom comply with the Food Information Regulations and Natasha’s Law allergen labeling requirements. Allergen information is provided by the manufacturer on the product packaging.

5.4 Canada

Food Products sold into Canada comply with the Canadian Food Inspection Agency (CFIA) requirements and the Food and Drugs Act. Allergen declarations and nutritional information are based on manufacturer labeling.

5.5 Australia & New Zealand

Food Products sold into Australia and New Zealand comply with the Australia New Zealand Food Standards Code. Allergen and nutritional information is provided by the manufacturer.

5.6 Germany & Austria

Food Products comply with the German Food and Feed Code (Lebensmittel und Futtermittelgesetzbuch, LMBG) and applicable Austrian food regulations. Allergen labeling follows EU and national requirements.

5.7 France

Food Products comply with the French Consumer Code and applicable French food safety and labeling regulations. Allergen information is provided by the manufacturer.

6. GWP Food Items – Special Provisions

All provisions of this Disclosure apply equally to Food Products provided as complimentary GWP items. The following additional provisions also apply:

6.1 Same Safety & Allergen Profile

GWP Food Items are subject to the same manufacturer safety, quality, and allergen standards as paid Food Products. However, GWP Food Items are promotional gifts and have no independent cash or redemption value.

6.2 Returns & Eligibility

GWP Food Items cannot be returned, refunded, exchanged, or credited separately from the main order. If your GWP eligibility is voided due to a return, refund, credit, or price adjustment and you elect to keep the GWP Food Item, the full MSRP value will be deducted from your refund in accordance with our GWP Promotion Rules.

Once opened or consumed, GWP Food Items are nonreturnable for food safety and hygiene reasons.

6.3 Manufacturer Responsibility

All safety, quality, allergen, and labeling matters for GWP Food Items are the sole and primary responsibility of the manufacturer. We will assist with manufacturer contact but assume no independent liability for GWP Food Items beyond what is required by applicable law.

7. Shipping, Transit & International Delivery

7.1 Transit Risk

Food Products are shipped using standard temperatureappropriate packaging where specified by the manufacturer. However, we do not guarantee continuous temperature control during transit, especially for international shipments.

We are not liable for spoilage, deterioration, melting, or quality degradation resulting from shipping delays, temperature extremes, customs clearance delays, or other conditions during transit. This applies equally to paid Food Products and GWP Food Items.

7.2 International Customs & Import Compliance

International shipments of Food Products may be subject to customs inspection, detention, or rejection by food safety, quarantine, or customs authorities.

Customers are solely responsible for compliance with all import regulations, food import restrictions, and quarantine requirements of the destination country.

We are not liable for packages seized, detained, confiscated, destroyed, or rejected by customs or food safety authorities. No refund will be provided for packages seized or rejected for regulatory compliance reasons.

Customs clearance time is not included in estimated delivery timeframes. Perishable Food Products are shipped at your own risk with respect to customs delays.

8. Special Population Advisory

· Pregnant or nursing individuals: Consult a qualified healthcare professional before consuming any Food Product, including nutritional supplements and sports nutrition products.

· Infants and young children: Consult a pediatrician before introducing new foods or nutritional products.

· Elderly individuals or those with compromised immune systems: Consult a qualified healthcare professional regarding dietary choices and food safety.

· Individuals with food allergies or sensitivities: Review manufacturer labeling carefully and consult a qualified healthcare professional if you have any questions regarding allergen content or crosscontamination risk.

· Individuals with medical conditions or taking medications: Consult a qualified healthcare professional before consuming nutritional supplements or specialty food products.

9. Disclaimers & Limitation of Liability

9.1 General Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL FOOD PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING FOOD PRODUCTS, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that Food Products are free from allergens, contaminants, or defects, or that consumption will be safe for any individual. All safety, quality, and nutritional representations are those of the manufacturer.

9.2 No Consequential Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR IN CONNECTION WITH FOOD PRODUCTS, INCLUDING BUT NOT LIMITED TO ALLERGIC REACTIONS, FOODBORNE ILLNESS, PERSONAL INJURY, OR LOSS OF USE.

9.3 Liability Cap

Our total aggregate liability for any claim arising from or related to any Food Product shall not exceed the total purchase price paid for the specific Food Product affected. For GWP Food Items, our total liability shall not exceed the full MSRP value of the applicable GWP tier.

The foregoing limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for personal injury or consequential damages, so the above limitations may not apply to you.

10. General Provisions

10.1 Severability

If any provision of this Disclosure is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while achieving the original intent.

10.2 Governing Law

This Disclosure shall be governed by the laws of the State of Delaware, United States of America, without regard to conflict of law principles. This does not exclude or limit any mandatory consumer protection or food safety laws that apply to you based on your place of residence.

10.3 Dispute Resolution

Any dispute arising out of or related to this Disclosure or any Food Product shall be resolved in accordance with the dispute resolution provisions set forth in our Terms of Service.

10.4 Updates

We reserve the right to update or modify this Disclosure at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our services after changes constitutes acceptance of the updated terms.
